Our client, an experienced tow truck owner and operator, responded to a call during a heavy snowstorm to assist a woman whose vehicle was stuck in the driveway of her cabin near a ski resort. While he was kneeling behind her car, hooking it up to his tow truck, she suddenly put the vehicle into reverse, pinning his head between the bumpers. Fortunately, a trailer hitch prevented fatal injuries, but he still suffered a traumatic brain injury (TBI) and vision impairment.
Through our investigation, we uncovered that the woman had been drinking heavily throughout the day. Although law enforcement did not pursue DUI charges at the time, she later admitted in her deposition that she may have been impaired. Armed with this evidence, we pursued her insurance company, which quickly settled for a substantial amount in compensation for our client.
